Aggressive Drunk Driving Defense

Whether the charge against you is called "operating under the influence" (OUI), "driving while intoxicated" (DWI) or "driving under the influence" (DU)I, or any other drinking and driving offense, you need legal help.

When you are charged with OUI/DWI/DUI, the full might of the government is against you. For years our governments, both state and federal, have systematically changed the laws relating to OUI/DWI/DUI. These changes throughout the country share a common goal: to make it easier for governments to convict people of OUI/DWI/DUI, put them in jail, and take their licenses.

State legislatures and Congress have systemically lowered the level of proof needed to convict people of OUI/DWI/DUI. They have abolished rules of evidence designed to protect against false convictions. In some states they have reduced the laws to the point where you can be convicted of OUI/DWI/DUI even if your driving ability is not actually impaired or you're not even driving!

Maine is one of those states. Maine OUI/DWI/DUI laws are among the toughest in the country. The Maine legislature has lowered the legal Blood/Alcohol limit from .15 to .10 and then to .08, while at the same time imposing higher maximum penalties, mandatory jail terms, crippling fines and fees; and license suspensions for longer and longer periods. In Maine, your license can be suspended even before you ever go to court.

As a result of these changes in the law, defense attorneys defending OUI/DWI/DUI cases must know more and more about constitutional law, police procedures and training, human physiology and scientific testing. This just levels the playing field with the District Attorney who is prosecuting your case. At the same time the state and federal governments have been changing the OUI/DWI/DUI laws; they have also devoted more and more money and resources to the prosecution of OUI/DWI/DUI cases. You must have an experienced defense attorney on your side protecting your rights. Beside an in depth knowledge of law and science related to OUI/DWI/DUI, a defense attorney must have extensive knowledge and experience in investigation, and the trial skills and experience necessary to adequately evaluate and defend an OUI/DWI/DUI case. Furthermore, this knowledge and these skills must be aggressively used to successfully defend your case.

Mr. Foote is Maine’s first and only Board Certified DUI Defense attorney. He has the knowledge, training and skills to successfully defend OUI/DWI/DUI or any other drinking and driving case. These abilities have been developed in defending more than a thousand OUI/DWI/DUI cases and hundreds of hours of special study and training. He is constantly researching new developments in the OUI/DWI/DUI case law and science, and applying those developments to his clients' cases. He will not simply allow the District Attorney to trample your rights, nor accept the police report as fact. His legal practice focuses on applying his knowledge and skills to your case. Mr. Foote is aggressive and tenacious in using his abilities to benefit you. The state puts all of its available resources into prosecuting your case. Mr. Foote believes you have a right to an equally aggressive defense.
