Attorney Wayne Foote’s Certifications
After graduating from law school, Attorney Foote continued his education by amassing extensive training in DUI defense from the National College for DUI Defense (NCDD) – the certification partner of the American Bar Association. In fact, Mr. Foote is the first and only attorney in Maine who is Board Certified in DUI Defense Law by the NCDD. Fewer than forty lawyers nationwide have achieved this level of expertise.
Mr. Foote also received Certificates of Achievement for successful completion of the NCDD’s Summer Sessions in 1998, 1999, 2000, 2001, 2003, 2005, 2006, 2007, 2008, 2010, 2011 and 2013; and the 2006 and 2009 Winter Sessions.
He is a Sustaining Member of the NCDD and was their Maine State Delegate from 2000 to 2008.

NCDD Board Certified: In 2007, Wayne earned the honor of being Maine’s only Board Certified OUI Defense Lawyer. Fewer than forty lawyers in America have earned such a high level of certification.
NCDD Sustaining Member: Wayne is a sustaining member of the National College For DUI Defense. Earning this stature requires multiple peer reviews as well as NCDD review to validate an attorney’s capabilities. Wayne’s sustained NCDD membership underscores his continuous commitment to superior service and to getting superior results in impaired-driving cases.
DRE Certification: Wayne completed the Drug Evaluation and Classification Program Course Overview according to National Highway Traffic Safety Administration and International Association of Chiefs of Police standards. With this training, he knows all the tools and tricks used by police officers in drug related OUI cases.
Intoxilyzer Maintenance: Wayne also completed the requirements needed to become a Maintenance Technician for the Intoxilyzer 5000. This training enables him to discover problems with the use and upkeep of Maine’s breath test machines.
Intoxilyzer Operator: In 2004 Wayne completed the requirements set by the US Department of Transportation needed to become a certified operator of the Intoxilyzer 5000 breath test machine. The Intoxilyzer 5000 is the breath testing machine used in Maine DUI cases. Understanding the Intoxilyzer 5000 is absolutely necessary to defend most Maine DUI’s.
Forensic Chromatography VI: Theory and Practice: In 2012 Wayne completed a 40 hour hands on course covering forensic chromatography.
Intoxilyzer 8000 Breath Alcohol Technician: In 2013 Wayne completed the requirements set by the US Department of Transportation needed to become a certified operator of the Intoxilyzer 8000 breath test machine. The Intoxilyzer 8000 is the Maine OUI breath testing machine.
Additional DUI Defense Certifications
Attorney Foote also successfully completed Mastering Scientific Evidence in DUI/DWI Cases in 2002 and 2005, Florida International University’s Breath Analysis Forensic Workshop in 2004 and the National Association of Criminal Defense Lawyers’ DWI training session in 2005.
Additionally, he completed the NHTSA/IACP Drug Recognition Evaluation Overview Program in 2008 and the Forensic Blood, Breath and Urine Testing Workshop in 2009.
